Effect of the Solomon-Pombo Amendment on Title IV Programs

The U.S. Department of Education (ED) recently issued a Dear Colleague Letter (DCL) that outlines the effect of the Solomon-Pombo Amendment to the Omnibus Consolidated Appropriations Act of 1997 on Title IV Student Financial Assistance Programs (SFA). The Amendment restricts the use of certain ED funds at institutions that have denied or restricted access of military recruiters or that have denied or restricted the operation of the Senior Reserve Officer Training Corps (ROTC). ED has determined that the following SFA programs are not affected by the Amendment:

The Federal Pell Grant Program The William D. Ford Federal Direct Loan Program The Federal Family Educational Loan Program (FFEL) The State Student Incentive Grant (SSIG) Program The Robert C. Byrd Honors Scholarship (BYRD) Program The National Early Intervention Scholarship and Partnership (NEISP) Program

The following SFA programs are affected by the Amendment:

The Federal Perkins Loan Program The Federal Supplemental Educational Opportunity Grant (FSEOG) Program The Federal Work-Study (FWS) Program
